1. Our service is available within the United Kingdom
2. We will cover the following:
i. prompt response to the scene of the breakdown following your call
ii.recovery of you and your vehicle from the scene of the breakdown to your home or temporary address as long as the temporary address is no more than seven miles from the point of breakdown.
3. We will use appropriate agents to provide assistance and transport you and your vehicle from the scene of the breakdown to your home or temporary address as long as the temporary address is no more than seven miles from the scene of the breakdown.
This cover is limited to one vehicle previously declared to us.
5. We only accept responsibility for the actions of an agent where the agent is acting on our instruction and is providing assistance to which you are entitled under your membership.
6. You must contact us using the contact details provided by us from time to time. If you contact another person, business or company direct for breakdown assistance then you are responsible for any costs incurred and we will not be obliged to reimburse you.
7. Any hood, canopy or other accessory attached to your vehicle must be removed prior to recovery of your vehicle.
8. We will not provide assistance where your vehicle is not kept in a roadworthy condition.
9. We will not cover the following:
(iii) the cost of replacement parts or other materials and garage or other labour required to repair your vehicle.
(iv) storing or guarding your vehicle in your absence.
(v) any other transportation costs except those covered by this policy.
(vi) any ferry toll or parking charges incurred as a result of recovery of your vehicle.
(vii) more than four call outs per year,
(viii) any breakdowns within the boundaries of your home.
10. You must inform us immediately of any change to your home address or any change to the vehicle insured.
11. We and our agents are not obliged to transport any animal or arrange alternative transportation of such animal. If we or our agents agree to transport an animal then it will be your responsibility to secure and ensure the safety of such animal and any such transportation will be at your own risk.
12. We and our agents may refuse to recover your vehicle if you are not with the vehicle at the time of breakdown and/or are unable to be present at the time assistance arrives.
13. We and our agents reserve the right to refuse to recover your vehicle if you cannot produce a valid membership card and, if requested, some other form of identification.
14. We and our agents have the right at any time to refuse to recover your vehicle if we or our agents reasonably consider that you are behaving or have behaved in a threatening or abusive manner.
15. We are not liable for any loss or damage to any contents of your vehicle.
16. You have the right to cancel your membership within 14 days from the receipt of your membership card. You will be entitled to a refund of your premium less a charge for the period cover. You must return any membership card provided and must not in any event make any future use of the cancelled membership.
17. If you wish to cancel after this period has expired we are not obliged to give refunds for any unexpired portion of the cover and if you pay by instalments you will still be obliged to complete any payment(s) due in relation to the period of cover in the policy.
18. We have the right to cancel your membership at any time for whatsoever reason giving 14 days notice. We will refund to you any unexpired portion of cover if paid in advance.
19. If Scooter Rescue Service fails in anyway to provide you with the service we claim in our advertising literature and you notify us of this then we will refund to you all monies paid for the preceding 12 months from notification.
20. We will automatically renew your membership at the end of each year. We will send you a written reminder and will advise you of any changes to the premium or cover (if any). If you do not wish your policy to be renewed then you must contact us at least seven days prior to the renewal date.
21. We reserve the right to vary these terms and conditions on going reasonable notice where we reasonably consider it necessary to do so.
22. We are not liable in the event that we are faced with circumstances beyond our reasonable control such as but not limited to Acts of God, events of national emergency, failure of telecommunications lines or systems, flood, snow, fog or other bad weather conditions, vehicle equipment or system failures, shortages of fuel or other necessary supplies, default of suppliers or subcontractors, theft, malicious damage, industrial action of any kind.
23. We will not in any event have any responsibility for any indirect or consequential losses incurred as a result of or in connection with any service, whether resulting from tort breach of agreement or otherwise. Nothing contained herein shall limit or exclude our liability in respect of death or personal injury caused by our negligence.
24. In the event that we are liable for any act or omission direct or indirect other than insofar as it may result in death or personal injury our maximum liability shall be limited to the refund of any premium paid under the policy during the current year.
25. If we fail to enforce or rely on any of these terms and conditions on any particular occasion or occasions this will not prevent us from relying on or enforcing them in the future.
26. These terms and conditions, and any agreement entered into in connection with the same, shall be interpreted in accordance with the English law and subject to the jurisdiction of the English Courts.
